1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of ZS Sections ("the App," "the Service") provided by ZS Sections ("we," "us," "our"). By installing, accessing, or using the App, you ("Merchant," "you") agree to be bound by these Terms.

If you do not agree to these Terms, do not install or use the App. These Terms apply alongside Shopify's Terms of Service and our Privacy Policy.

2. Description of Service

ZS Sections is a Shopify application that provides:

• A library of pre-built, customizable Shopify sections (HTML/Liquid/CSS/JS code)
• One-click installation of sections into your Shopify theme
• In-app and email-based customer support
• Free updates for purchased sections

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice for major changes.

3. Account & Eligibility

3.1 Eligibility

To use the App, you must:

• Be at least 18 years old or the legal age of majority in your jurisdiction
• Have an active Shopify store
• Have authority to bind the business entity using the App
• Not be barred from receiving services under applicable laws

3.2 Account Security

You are responsible for maintaining the security of your Shopify account. We are not liable for unauthorized access resulting from your failure to safeguard credentials.

4. License & Usage Rights

4.1 What You Get

When you purchase a section, we grant you a non-exclusive, non-transferable, perpetual license (subject to these Terms remaining in effect) to:

• Install the section in any Shopify theme within your store(s)
• Modify the section's code for your own use
• Use the section for commercial purposes on your storefront
• Receive future updates to that section at no extra cost

4.2 What You Cannot Do

You may NOT:

• Resell, redistribute, or sublicense the sections to third parties
• Share section files publicly (e.g., GitHub, design marketplaces)
• Use sections to create a competing product or section library
• Remove copyright notices, attribution, or branding from section code
• Use the App in stores you do not own or have explicit authorization to manage

4.3 Agency & Multi-Store Use

Agencies and developers installing sections on multiple client stores must purchase a separate license for each store. Each license is processed through that store's own Shopify Billing account.

5. Payment & Billing

5.1 Pricing

Section prices are listed inside the App in USD. Prices are subject to change, but existing purchases are not affected by future price changes.

5.2 Payment Method

All payments are processed exclusively through Shopify's Billing API and added to your regular Shopify subscription bill. We do not collect or store credit card information directly, and no payment is processed outside of Shopify.

5.3 Taxes

Prices are exclusive of applicable taxes. You are responsible for any sales tax, VAT, GST, or similar taxes required by your jurisdiction.

5.4 Failed or Unpaid Charges

If your Shopify Billing charges fail or remain unpaid, Shopify may automatically restrict your access to paid features of the App until payment is resolved through your Shopify account.

6. Refunds & Cancellation

We offer a 30-day money-back guarantee on all prebuilt sections. Since all charges are processed via Shopify Billing, refunds are issued back through your Shopify account.

Eligible for refund:

• Section does not work as advertised after reasonable troubleshooting
• Technical incompatibility we cannot resolve within 7 days
• Request submitted within 30 days of purchase

Not eligible for refund:

• Change of mind after 30 days
• Sections heavily modified beyond original code
• Charges resulting from misuse or violation of these Terms

7. Prohibited Uses

You agree not to use the App to:

• Violate any law, regulation, or third-party rights
• Distribute malware, spyware, or harmful code through your store
• Engage in fraud, scams, or deceptive practices
• Reverse engineer or extract code from app backend systems that are not delivered as part of the section files
• Conduct automated scraping, mass downloading, or bulk data extraction
• Resell access to the App or any of its sections
• Use the App to host or display illegal, harmful, or hateful content

Violation may result in immediate account termination without refund.

8. Intellectual Property

All content in the App — including section designs, code, graphics, logos, and documentation — is owned by ZS Sections or our licensors and protected by copyright and trademark laws.

Your store data, products, and customizations remain entirely yours. We claim no ownership over content you create using our sections.

8.1 Feedback & Suggestions

If you submit feedback, feature requests, or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without obligation or compensation.

9. Warranty Disclaimer

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• Sections will work perfectly with every theme variation
• The App will meet all your specific requirements
• Defects will be corrected immediately

We make commercially reasonable efforts to maintain quality but cannot guarantee perfection across all Shopify configurations.

10. Limitation of Liability

To the maximum extent permitted by law, ZS Sections shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, lost revenue, lost data, or business interruption
• Damages exceeding the amount you paid us in the 12 months preceding the claim
• Issues caused by Shopify, third-party themes, or other apps

This limitation applies regardless of the legal theory of liability.

11. Termination

11.1 By You

You may stop using the App at any time by uninstalling it from your Shopify admin. Section files already installed in your theme will remain as standard Shopify Liquid files even after uninstallation.

11.2 By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent or harmful behavior
• Fail to pay outstanding Shopify charges
• Misuse the App in ways that harm other users or our reputation

In case of termination for cause, no refund will be issued.

12. Governing Law & Disputes

ZS Sections serves merchants worldwide through the Shopify App Store. These Terms are governed by the laws of the jurisdiction of our principal place of business, without regard to conflict of law principles.

We will attempt to resolve any disputes through good-faith negotiation first. Where local consumer protection laws apply to you as a merchant or end user, those laws take precedence over this section and remain fully in effect regardless of any provision in these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App and by email at least 30 days before they take effect. Continued use of the App after changes take effect means you accept the updated Terms.
